Is AI cold calling legal in the US?
Usually not without consent. Since the FCC's February 2024 ruling, AI-generated voices count as "artificial or prerecorded voice" calls under the TCPA. Calling a cell phone that way needs prior express consent, and telemarketing calls need prior express written consent.
Do I need consent if a real person dials by hand?
Generally no TCPA consent is required for a live person dialing manually, because no artificial voice or autodialer is used. Do-not-call rules, calling hours and state laws still apply.
What are the TCPA calling hours?
Federal rules allow telemarketing calls between 8am and 9pm in the called person's local time. Some states are stricter: Florida, Oklahoma, Maryland and Washington limit sales calls to 8am–8pm, Connecticut to 9am–8pm, and Texas to 9am–9pm (noon–9pm on Sundays).
Can I call numbers on the Do Not Call list?
Not for telemarketing, unless you have an established business relationship (a purchase in the last 18 months or an inquiry in the last 3 months) or the person's written permission. You must scrub your lists against the registry at least every 31 days.
What are the penalties?
The TCPA allows $500 per violating call, up to $1,500 if willful or knowing, and cases are often filed as class actions.
