Can AI make sales calls (or cold calls) for me?

Technically yes. Legally, an AI voice making sales calls to cell phones or homes needs prior express written consent. Here's what AI can do today, what it can't, and how teams get the phone step done anyway.

The short answer

  • AI can place the call technically. Voice agents can dial, talk, handle objections and book meetings.
  • The law treats that AI voice as a robocall. The FCC's February 2024 ruling (FCC 24-17) says AI-generated voices are "artificial or prerecorded voice" calls under the TCPA.
  • Sales calls with an AI voice need prior express written consent when they go to a cell phone or a residential line. That's a signed (or e-signed) agreement naming your company and the number. A recent inquiry or a past purchase isn't enough.
  • Cold calls don't come with written consent, so AI-voice cold calling is effectively off the table in the US.

"Live-agent-equivalent" AI isn't a loophole

Some vendors argue their AI is "like a live agent." The FCC rejected that: the TCPA "does not allow for any carve out of technologies that purport to provide the equivalent of a live agent." Even a human clicking pre-recorded clips (a "soundboard") counts as an artificial voice.

FAQ

Can AI make cold calls for me?

Not with an AI voice, in practice. AI-voice telemarketing calls to cell phones and residential lines require prior express written consent, which cold leads haven't given. An AI agent can still prepare and route the call to a human.

Can AI make outbound sales calls to my existing customers?

Only with prior express written consent for AI or artificial-voice calls. An existing business relationship lets a live person call numbers on the Do Not Call list, but it doesn't authorize artificial-voice telemarketing.

Is it legal for AI to call businesses?

Calls to a true business landline face fewer federal rules, but many small businesses use cell phones, and AI-voice calls to any cell phone need consent. B2B exemptions don't cover the artificial-voice rules.

What's the penalty for AI-voice calls without consent?

The TCPA allows $500 per call, up to $1,500 if willful, and cases are usually filed as class actions. AI-voice class actions were filed against a mortgage lender and three law firms in 2026.
